Judge to rule soon on alcohol suit

Twenty-second Judicial District Judge Martin Coady on Thursday said he would take the issue of alcohol sales in Bogalusa on Sundays under advisement and would come back with a ruling within 10 days. At that time, he will give reasons for his judgment, he said.

The action was in response to a lawsuit filed in December by Bogalusa resident John H. Johnson after the city council passed two ordinances to legalize sales of alcohol in restaurants and stores from 11 a.m. to 6 p.m. on Sundays.

The suit claims those ordinances should be considered “null and void” because while state law provides that the city “may adopt ordinances ‘regulating or prohibiting’ the opening of certain businesses and/or the sale of certain stock or articles of merchandise on Sunday, if approved by the voters at an election…” no such election was called, advertised or conducted.

The lawsuit goes on to say the ordinance making it legal for grocery and convenience stores to sell alcohol on Sundays was voted on by the city council without proper invitation for public input.

The council passed both ordinances with votes of 5-2. They went into effect on Dec. 20.
